All parties to the construction process, whether developer, builder, construction company, consultant (for example architect/structural engineer/quantity surveyor) and the private individual commissioning domestic new build or renovation, require contracts to regulate and govern their relationship and interleaving responsibilities. The type of contracts we recommend and negotiate depend on the procurement route, the complexity of the project, the need for sub-contractors and suppliers and the value of the project.
The most common form of contracts used are the JCT 2005 family which provide a raft of contract types from the Home Owners contract (for lower value simple projects) to a contract which will regulate the most complex and high value project. Ancillary contracts may also be required such as sub-contracts, collateral warranties (making sure that parties who do not directly contract with each other can rely upon obligations given by each other to intermediate contractors), guarantees and bonds. |
