Restructuring a business is probably one of the more difficult and challenging situations an employer will face, in particular when it involves redundancies. Along with this an employer may need to consider re-training, re-deployment, bulk recruitment and potential relocation. VSH are on hand to assist employers with the whole process. Long after carrying out a business re-structuring the real hard work starts with ensuring that there is a smooth transisition to the new structure from the old one and we are able to offer direct access and guidance which will help clients with costs, management time and unnecessary upset and disruption.
Many of our clients have required guidance and advice on the following areas:
- setting up procedures to ensure that a fair process is followed when dealing with dismissals (including redundancies);
- managing the bulk relocation of employees including the application of the UK and EU rules on the transfer of undertakings (TUPE);
- trade union matters, collective bargaining, recognition agreements and industrial disputes;
- minimising the risk to the employer when terminating employment contracts e.g. through the use of compromise agreements
We also advise employees who are faced with dismissal claims (including redundancy), often advising on settlement of such claims through compromise agreements or, more rarely, advising them on the procedure and merits of tribunal cases.
